The company's comprehensive legal response counters claims portraying the game as a "mass shooter training ground," presenting expert testimony to refute such allegations. Families of the Uvalde victims have until late February to file their rebuttal to Activision's extensive documentation.

Filed in December, Activision's 150-page defense comprehensively rejects all accusations of culpability in the May 2022 Robb Elementary School tragedy. The lawsuit, initiated by grieving families in May 2024, alleges the shooter's exposure to Call of Duty's violent content contributed to the massacre that claimed the lives of 19 children and two teachers, injuring 17 more. The shooter, a former Robb Elementary student, played Call of Duty regularly, downloading Modern Warfare in November 2021, and utilized an AR-15 rifle, similar to those depicted in the game. The plaintiffs also implicated Meta, claiming Instagram facilitated the shooter's connection to firearm manufacturers, exposing him to AR-15 advertisements. The lawsuit argued that both Activision and Meta fostered a harmful environment that exploited vulnerable adolescents, indirectly encouraging violence.

Activision's legal strategy utilizes California's anti-SLAPP (Strategic Lawsuits Against Public Participation) laws to protect its free speech rights. The company emphasizes Call of Duty's status as a protected form of expression, arguing that claims based on its "hyper-realistic content" infringe upon this fundamental right.

A 35-page statement from Notre Dame professor Matthew Thomas Payne contextualizes Call of Duty within the tradition of military realism found in film and television, directly contradicting the "training camp" assertion. Furthermore, a 38-page declaration from Patrick Kelly, Call of Duty's head of creative, details the game's development, including the $700 million budget allocated to Call of Duty: Black Ops Cold War.
